Judicial citizenship: frequently asked questions

How long does a case take?
There is no fixed duration that applies to every court claim. Separate document preparation, time in court and registration after a favourable decision. An estimate must refer to the competent court and the actual state of your file; it is not a guaranteed passport date.

Do I need to travel to Italy?
A lawyer can generally handle the claim under a valid power of attorney without routine attendance by the applicant. Confirm how the power of attorney must be signed abroad and whether any specific step in your case requires your presence.
What documents will I need?
Start with a dated family tree, the Italian ancestor's birth record and available naturalisation records. Civil-status evidence must connect each generation; the lawyer then identifies any further records and translation or legalisation requirements. Do not assume every foreign document needs the same formalities.

How much does it cost?
Ask for an itemised quote separating legal fees, court charges, documents, translations and post-judgment work. The Ministry of Justice's 16 January 2025 circular explains the €600 court contribution for each claimant, including in a joint case. Sharing legal work does not remove that individual charge.

What happens after a favourable judgment?
Finality and the required court documents must be checked, followed by civil-status registration with the competent municipality. Applicants living abroad should confirm the applicable AIRE and consular steps before applying separately for a passport.
Does a female ancestor always mean a 1948 case?
No. The relevant date is the birth of the child through whom the maternal line continues, not simply the woman's birth date. A pre-1948 maternal link raises a specific issue, but naturalisation, the rest of the family line and current eligibility rules must also be checked.

Can relatives apply together?
Sometimes, after checking jurisdiction, the common line and each person's position. Shared ancestors do not automatically give every relative the same eligibility, documents or outcome. Ask which costs are shared and which remain individual.
Does a refusal or a long wait guarantee a court route?
No. A lawyer must distinguish a final refusal, a request for missing documents, an appointment problem and a pending application. The reasons, dates, applicable law and available evidence determine what remedy, if any, is appropriate.
