The legal time limit

The relevant time limit depends on the procedure and the facts. A lawyer should verify when the application was validly submitted, whether it was complete and what subsequent communications changed its status.

What counts as an unreasonable delay

A delay may justify examining a legal remedy, but it does not prove the applicant meets the citizenship requirements. The appropriate claim and jurisdiction must be assessed before filing.

How the court claim works

The claim asks the court to recognise your citizenship directly, rather than waiting indefinitely for the consulate. The same genealogical evidence prepared for the consular application supports the case.

A favourable judgment is transcribed in the relevant Italian municipality and lets you proceed to AIRE registration and your passport.

Before asking about court action

Separate an inability to book an appointment from a complete application already filed. Keep receipts, protocol numbers, appointment messages, document requests and your replies in date order. A waiting-list entry alone should not be treated as proof of a complete application.

Ask the lawyer to identify the procedure, any applicable time limit and the appropriate remedy. Delay does not establish citizenship eligibility or automatically disapply the rules introduced in 2025.
